According to the Copyright Act, 1957, with amendments thereof read with International Conventions & Treaties, Video & Audio public performances are widely emphasised and interpreted as making any work available for being seen, heard, or otherwise enjoyed by the public, directly or by any means of display or diffusion, regardless of whether any member of the public actually sees or hears the work.

Recent court rulings by Honourable Bombay High Court, have further explicitly clarified the rights on issuance of licenses and collection of public performance royalties u/s 30 of Copyright Act 1957 , that are owned by the Owners.

Importantly, collection of Public performance rights of Cinematograph Film (VIDEO) and Sound recording works (AUDIO) on behalf of owners are on the basis of “single window concept” for Video & Audio public performance rights (combined), endeavoured by the Ministry of Commerce and Industries, DPIIT, Copyright Division,New Delhi with notifications, by the Central Government/ Enforcement authorities and adhering strictly in accordance to the Court Orders of the Honourable Courts.
