1. Work : Cinematograph Film Work (Video) as given U/S. 2(y)(ii) Read With Section 13(1)(b) of the Copyright Act 1957.

Eligibility criteria for members, for receiving VIDEO public performance royalties from AVPL:

The following details to be furnished while submitting the membership form and assignment agreement of video public performance rights.

* List of Cinematograph Film (VIDEO) by the Producers or Owners, as the case may be.

* List of “Special rights” in respect to Visual recording / Cinematograph Film (VIDEO) rights from the Producer of the Film or event companies (Live/Studio recording) in respect to visual presentation of the performer, as provided u/s 38 & 38A, specifically read with 38A (2) of Copyright Act 1957 and Copyright Rules 2013.

Premise:

* As per Section 2(f) of Copyright Act 1957, "cinematograph film" means any work of visual recording and includes a sound recording accompanying such visual recording and "cinematograph" shall be construed as including any work produced by any process analogous to cinematography including video films;

* · Producer, the first owner or the subsequent owners, subject to compliance with chain of title documentations having negative rights of the cinematograph Film work, which includes production companies, YouTube / digital platform producers , studios , intermediary content owners etc., owning in any Indian 🇮🇳 languages the - feature films, OTT films, dubbed films, short films, documentaries etc., assign the VIDEO Public performance rights to AVPL, in respect to communication to the public as interpreted u/s 2(ff) of Copyright Act 1957 , for collection of Video royalties from public establishments / venues and to distribute the royalties as per the terms agreed upon under the consideration clause.

2. Work : Sound recording work (audio) as given U/S 2(y)(iii) read with Section 13 (1)(c) of the Copyright Act 1957.

• Eligibility criteria for members, for receiving AUDIO public performance royalties from AVPL:

The following details shall be furnished while submitting the membership form and assignment agreement of Audio Public Performance rights:

* List of Sound recording Works (audio)

* List of audio-video clips combined, if any, which are not part of the cinematograph film.

* List of “Special rights” in respect to Sound recording rights with acusitic presentation of performer from Producers or event companies, (Live/Studio recording) as provided u/s 38 & 38A of Copyright Act 1957 read with Copyright Rules 2013.

Premise:

* Section 2(xx) of Copyright Act 1957, "sound recording" means a recording of sounds from which such sounds may be produced regardless of the medium on which such recording is the method by which the sounds are produced;

* Producers , the First Owner or the subsequent owners of negative sound rights of Sound recording work in any Indian 🇮🇳 languages, pursuant to Section 2(t) of, Copyright Act 1956 , subject to compliance with chain of title documentation from production companies, YouTube / Digital platform Producers , OTT content producers, Studios , Music labels , Intermediary Content Owners etc. assign the AUDIO Public performance rights to AVPL , in respect to communication to the public as interpreted u/s 2(ff) of Copyright Act 1957 , for collection of Audio royalties from public establishments / venues and to distribute the royalties as per the terms agreed upon under the consideration clause.
